Hey guys. I received this via MHJC Alert email today. I figured I'd post it here so y'all can write letters and what not.

THE STATE IN ALL THEIR WISDOM TRADED A PORTION OF
LAND ON THE WEST SIDE OF THE LONE CONE TO BRAD GRAY. THIS PORTION HAD FOREST SERVICE ROAD 534 SAN JUAN FOREST RUNNING THRU IT. THE STATE DID NOT RETAIN RIGHT OF WAY FOR FOREST SERVICE OR EITHER COUNTY, SAN MIGUEL OR DOLORES. THE
NEW OWNER, BRAD GRAY, HAS BUILT A LARGE BERM, OVER 8 FEET HIGH AND DEEP TRENCHES ON EITHER SIDE 4' DEEP, RIGHT ON THE SAN MIGUEL/DOLORES COUNTY
LINE. ALL ACCESS TO THE FOREST ON THE WEST SIDE OF THE CONE IS NOW CUT OFF.

THE FOREST SRVICE CLAIMS THAT THEY KNEW NOTHING OF THIS TRADE. SAN MIGUEL CTY SAYS THE WROTE A LETTER ASKING FOR THE STATE TO RETAIN THEIR RIGHT OF WAY. DOLORES CTY I HAVE NOT BEEN ALBE TO FIND ANYTHING OUT. PLEASE PUT THE WORD OUT AND HAVE EVERYONE CONTACT THE ABOVE AND VOICE THEIR CONCERN OVER THIS CLOSURE.

I would think that since the FS is handled by Federal Agencies, the State cannot simply hand over the rights to a road, the property maybe, but not the right of way. From the sounds of it, San Miguel County did not agree to losing the ROW either. There has to be a paper trail and as we all know that can be biotch to get and track. All of these types of trades have to come up for some level of approval and if it was not posted, a session provided for it and then voted on the legality of this could in question. But just ask Boulder County how they deal with it.

We could always fall back on the scourge of the green army and use the good ole RS2477 rule. Just need to track the age of the road. There is also a small ruling that says you cannot close off access to any public land. So if the land on the opposite side of the property has lost all access, that would be the biggest tool to open up the road back up. But that only works if there is no other way in.

Unless the FS and San Miguel County want to get involved legally, there isn?t really much we can do but voice our opinion and try to get them to take up the torch. I?ll see what I can dig up and post more later.

the state can not do anything with the road. it is the county and if the state did do it we have them dead. because they have told me too many times that they could do nothing on bd and i have this from the govs office. so the county needs to step up and i will be glad to share names and numbers and info.
talkin out of both sides dont cut it

Actually the road that was blocked was an illegal one. I contacted them and got the legals, the FS road dosen't even cross the land. Someone didn't do their homework out there. The land is to the West of the road.
