View Full Version : Are Bankruptcy Filings Public Info

The rumor mill in my industry is providing me info that one of my customers may be or has filed for bankruptcy.

I want to find out, and it's not really the kind of thing you can call and ask the buyer, if you know what I mean.........

So, does anyone know if bankruptcy filings are public info in Colorado, and where would I look?

I believe they are. For one thing, any creditor or potential creditor has to be notified of a bankruptcy proceeding in order to be able to have a say in the distribution of the bankruptcy estate. Creditors also have to be notified of a bankruptcy filing because once a bankruptcy petition is filed, all collection actions are stayed by law (and there are serious penalties for violating the stay by continuing collections actions after the petition has been filed.)

Remember that bankruptcy is a Federal, not a state, petition. Your best bet would be to contact the bankruptcy court and talk to them. I don't have their contact information but you should be able to find it pretty easily.

8. How can I get information about a case?
There are several ways you can get information about a case:
1. If you have access to a computer with internet access, you can get access to the Court?s electronic records through PACER. In order to use PACER, you must open a PACER account. You can do that by calling (800) 676-6856 or (210) 301-6440 to get a registration form, or you can apply online at http://pacer.psc.uscourts.gov/register.html (http://pacer.psc.uscourts.gov/register.html). It takes about a week to receive your login and password from the PACER service center. Once you are registered, you can access PACER through the internet or with a dial-up number. PACER costs are billed quarterly. Accessed on the internet, the cost is $.08 per page for downloading case information. Accessed through the dial-up number, the cost is $.60 per minute.
2. You can come to the Clerk?s Office, on the first floor of the Custom House, 721 Nineteenth Street, Denver, Colorado 80202-2508. All files are electronically maintained and are available for public viewing and copying on weekdays between 8:00 a.m. and 5:00 p.m., excluding federal holidays. 3. You can call the Voice Case Information System (VCIS) at (720) 904-7419.

They already have them as electronic files and they charge $.08 per page to look at them? Holy crap!
