in this situation.....
Scenario: I loan my pickup truck & 16ft car trailer to friend (soon to be ex friend), (ex) friend picks up trailer friday nite w/ full tank of gas and NO problems (truck or trailer).
I get truck & trailer back monday evening with one flat tire, crushed fender and a MEAN rattle from the brake pedal when I stop & NO gas in it :(
Move up to Wednesday, told friend how much to replace the trailer tire(s) and 4 rotors & pads (what I see in damage anyway). Friend basically blows me off like its MY FAULT the rotors were shot (after he & his girlfriend took it BTW) & the tire got a flat due to the fender rubbing the sidewall until it popped, and the spare's sidewall is done due to the fender rubbing. I'm about to pop a fawkin gasket and go postal......
What would you do to allievate the problem??
Angry as ***** in Denvah

MP - he needs to at MINIMUM pay for the trailer tire and the fender damage. I know you just put roters & brakes on the truck. brakes probably aren't bad but the roters are warped. Have him pay to have them turned.
$70 new tire
$70 for fender repair
$80 to take it to a shop and have them pull and turn the roters.
$60 for a full tank of gas
$20 for general agravation surcharge
$300 TOTAL
If not small claims court.

I'm just hella pissed right now. Thats EXACALLY the amount I threw out, suckin up the time, that I figure covers 2 new trailer tires (spare & destroyed one) and a pad slap/rotor turn. Got NOTHING but shit from the guy.
I can just do the work here after hours, just the principal of NO accepting responability.

Bummer, MP.
What would I do? I don't know about the small claims thing- $300 to find out if a friend is really a friend is probably not a bad deal. I would think that pursuing $300 would not be worth it in terms of time, effort, and bad energy/frustration, so I'd probably drop the money part, give him the "free bad vibe" and move on.
It sucks when you try to help someone out, and you get screwed. Good excuse to go have some beers, tho!

I have lost far more than that to so called friends. I think it is worth walking away and writing it off as a leason learned on who that person is. I probably would let them know how I feel about it and leave it at that. If this person is that much of a chump, he wouldn't need to be my friend anymore.

Biff: I can't believe you did this, McFly. I can't believe you loaned me your car without telling me it had a blindspot. I could have been killed!
George: Biff, I never noticed any blind spot before.
Biff: It's there, McFly how else can you explain this?
George: Can i assume that you insurance will pay for this?
Biff: My insurance? It's your car! Your insurance should pay for it. I wanna know who's gonna pay for this! (Indicates his stained polyester suit) I spilled beer all over it when that car hit me. Who's gonna pay the cleaning bill?

I just got back from the dentist and I'm drugged as hell fellas. Seriously it's not really worth pursuing it, I'm gonna chalk it up to a lesson learned, be more of a meiser about loaning out my shit. I just hate people who pull f*(kin stunts like this though. Money is money and whatever on the cash front, just dips into the jeep parts fund. My free time is precious as hell though :(.

I would say do what ya can do to get the money, it not, then dont be his friend any longer...

Thats where I'm at Clint, if he steps up cool, no foul. If not were done as friends. I dont plan to dick any of my other friends when it comes to helping them, but I'm planning to be a bit more cautious overall.

I have been on the other side of this dilema. borrowed a buddies trailer one time, about 30 miles down the road, I noticed the bearings on one of the hubs were completely blown out. I replaced them and lubed all 4 hubs, at that time it became apparant that the trailer probably hadnt seen lube since the assembly plant. The spindle must have been damaged from the previous bearing damage, because the new bearings didnt last but a few hundred miles. I had a trailer place look at it, put new bearings in it, had the trailer place look at it again, they didnt think there would be a problem. By this time I was feeling bad about the trailer causing so much trouble while in my possesion, so I cleaned it off and reprimed and then painted all the metal again (it needed it badly). I figured with the visual once over and ok from the trailer place, and the new paint, it was ok to return it. By this time, we had another buddy that wanted to use it, so he came to my place to pick it up, the bearings lasted about 50 miles. was I in the wrong?

I'm not sure the small claims court idea would work for such a relatively small amount. And once things get "legal", then you'd be in a situation where you'd have to prove it was his fault and not some pre-existing defect in the equipment that appeared while he had it. Add to that the time you'd have to take preparing all that evidence and probably having to take time off work - I think you'd get over $300 real quick.
Unfortunately, stuff like this happens, which is one reason I'd never loan my truck, motorcycle or trailer (if I had one) to someone not related to me. If a friend has a large load he has to haul, I'd be happy to volunteer my time and my truck - but the truck will stay with me, and I'll be the one driving it.
It sucks to say it, but you spent $300 to find out this guy isn't a real friend. There are others out there who spend a whole lot more to find out the same thing. :(

More than 300 bucks, just threw out a peon amount though. Time to fix my shit is more valuable than anything else honestly. But he's tryin to make it right, friend who bummed truck kinda stepped up, came by with two new trailer tires, to make amends as I left work this evening.
